1. Introduction

Welcome to Choice Technologies Ltd, the company operating the CHOICE platform. These Terms and Conditions govern your use of our platform and services, including all content such as text, graphics, and multimedia. By accessing or using the platform, you agree to these Terms.

2. Eligibility and KYC Process

Users must be at least 18 and legally permitted to use our platform and provide or consume the respective services in the respective jurisdiction. A mandatory Know Your Customer (KYC) process requires a valid official identity document and a selfie to be uploaded to our identify verification provider Sum and Substance Ltd. (https://sumsub.com). Failure to pass this process prevents a customer from making a booking request and a provider from publishing their profile.

3. Login

Access to an account is granted through a verified phone number, Telegram, Google or Apple account. Verification of the phone number can be done either via text message (only available in certain countries) or WhatsApp. After the correct verification code is entered access to the user account is granted. Users are responsible for making sure their mobile devices are password protected and to report any loss of access to the device so their account can get blocked. Sharing access to user accounts is strictly prohibited and will lead to immediate and indefinite account suspension.

4. Provider Profiles & Content

Providers must create a profile detailing their services, prices, locations, and availability. Providers are obliged to enter information truthfully and accurately. Providers are only allowed to share content that depicts themselves. In case other people appear in content shared or sold proof of consent needs to be available and other people appearing in the content need to have an approved CHOICE profile (active or inactive) to prove they are at least 18 years old.

5. Customer Registration and Use

Customers must register to use the platform. They can view providers, chat, share content, pay for content received and tip. To send booking requests it is necessary to complete the KYC process first and provide a full deposit of the entire service fee into our escrow account. The booking fee and services can be paid by credit card, TWINT (Switzerland only), Postfinance (Switzerland only), SMS (Switzerland only) and telephone (Switzerland only). Payments are processed by Doing GmbH (TWINT, Postfinance, SMS, telephone) and Only U Ltd. or PayPal for credit card payments.

6. Cancellations & Refunds

All payments made between a customer and a provider for messaging, paid content and tips are strictly non-refundable. All services by providers are rendered on a best-effort basis and do not include any guarantees our outcomes. Payment is strictly made for the time of the provider in the respective service type category. Consent can always be withdrawn and/or the services provided restricted at the full discretion of the provider. Deposits made for booking requests are fully refundable for meetings cancelled at least 24 hrs before the agreed meeting time or in case the provider has to cancel the meeting due to unavailability or other personal reasons or in case of a no-show by the provider. In case the meeting is cancelled by the customer less than 24 hours before the agreed meeting time, there is a no-show or a CHOICE Code violation by the customer the funds are immediately released from escrow to the provider.

7. CHOICE Code

All users must adhere to the CHOICE Code, outlining behavioral guidelines on the platform. Non-compliance can result in account suspension or termination. Compliance is checked at least after each meeting between providers and customers but failure to do so can be reported at any time at [email protected].

8. Intellectual Property

All content on the platform is owned by Choice Technologies Ltd or its licensors. Users are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the platform's content in accordance with these Terms and Conditions.

9. Limitation of Liability

Choice Technologies Ltd is not liable for any damages or losses resulting from platform use or services provided by providers. The platform is offered 'as is' without any warranties regarding its reliability or suitability.

10. Indemnification

Users agree to indemnify Choice Technologies Ltd and its affiliates against claims, damages, losses, or expenses arising from their use of the platform or breach of these Terms.

11. Governing Law and Jurisdiction

These Terms are governed by Swiss law. Disputes related to these Terms and Conditions or platform use will be resolved by the responsible courts of district 1 in Zurich.

12. Changes to Terms

Choice Technologies may modify these Terms at any time without prior notice. Continued access or use of the platform after modifications indicates agreement to the revised Terms.
